Terms and conditions Shimoni-Aqua ventures
DEPOSIT/CANCELLATIONS
All bookings require a minimum deposit of 50% of the applicable excursion cost. In the event of a cancellation 100% of the deposit will be refunded if the cancellation is made 72 hours in advance. If a cancellation is made between 24 and 72 hours in advance then 50% of the deposit will be refunded. No refunds will be given for cancellations made within 24 hours of the commencement of the excursion.
PRICES
Shimoni Aqua-Ventures Ltd reserves the right to change prices without notice, although every effort will be made to communicate any changes in advance with sufficient notice.
ROAD TRANSPORTATION
Where applicable, cars, minibuses, land rovers or coaches will be provided according to the number of clients. Shimoni Aqua-ventures Ltd reserves the right to employ the services of a sub-contractor.
ALTERATION TO TOUR/EXCURSION
Shimoni Aqua-ventures Ltd reserves the right to change any route, itinerary, schedule or arrangements should conditions necessitate, to offer substitutes of equal value or to cancel, in part or full, the operation of its scheduled tour/excursion. The right is also reserved to decline to accept or retain any person as a member of the tour at any time, in which event an equitable amount will be refunded.
LIABILITY
a) Shimoni Aqua-ventures Ltd is insured against legal liabilities arising from injuries, which might be received by passengers whilst in its vehicles or boats.
b) Shimoni Aqua-ventures Ltd's liability to passengers carried in its own transportation is governed by the laws of the Republic of Kenya and no other country and all claims are subject to the jurisdiction of the courts of the Republic of Kenya.
c) Shimoni Aqua-ventures Ltd reserves the right to employ sub-contractors to carry out all or any part of the services agreed to be supplied.
d) Whilst every care is taken, Shimoni Aqua-ventures Ltd does not accept responsibility for loss of or damage to personal effects, baggage or equipment. It is therefore advisable that clients effect separate insurance cover for such items.
